This seminar is taught by speaker, Robert A. Weissman, an attorney, currently representing a wide variety of subcontractors, many general contractors and some suppliers in many aspects of the construction project from reviewing, revising and updating credit applications and subcontracts, to ongoing construction problems, including the decision to the leave the project and disputes with extra work, to collection of amounts owed, by recording Mechanics’ Liens, serving Stop Notices and sending demand letters to filing complaints in all counties in California for enforcement of Mechanics’ Liens and Stop Notices and for breach of contract claims.
Part 1 – Beginning the Paroject
This section features a discussion on contracts/credit applications. The discussion focuses on the importance of a written contract and its components, whether you are a general contractor contracting with a property owner or a subcontractor, or a subcontractor contracting with a general contractor or a supplier of materials or equipment.
The seminar continues with a discussion on personal guaranties and joint check agreements.
The section concludes with a discussion on preliminary notices, including completion blank by blank. Examples are provided for both private and public projects and for suppliers and contractors. If requested, we will provide you with information on services that can help you complete the forms.
Part 2 – The Ongoing Project
This section focuses on the four statutory release forms, conditional progress and final and unconditional progress and final. Each form is discussed and completed examples are provided.
After the discussion on releases, Robert Weissman will discuss change orders, including the importance of getting them signed, how to obtain change orders and how to receive payment for oral change orders. He may not have all the answers, but he can explain the law and give some helpful advice.
After the discussion on change orders, the seminar focuses on making the decision to leave the project or refusing to supply any more materials to the project.
Part 3 – Collections
This section is all about collections. We begin the section with private project collection. Our first topic is Mechanics’ Liens. We will explain the law and teach you to complete the form blank by blank. We will also talk about releasing the Mechanics’ Lien in full or partially, as well as bonding around the lien, extending the lien and deadlines for recording and enforcing the Mechanics’ Lien. The private project collection concludes with a discussion on serving a Stop Notice to a property owner and lender.
Next we will discuss public project collections. First, we will talk about Stop Notices to public entities, along with releases, bonding around and disputing a Stop Notice. We will complete the form blank by blank and give you the time deadlines. Then we begin our discussion on payment bonds for both state and federal projects.
We will complete this section on contract statute of limitations, general collections (letters and telephone calls) and Small Claims Court, along with some tips on collecting a judgment.
